Ngày 22/1/2025, Thái Lan chính thức trở thành quốc gia ĐẦU TIÊN Đông Nam Á hợp pháp hóa hôn nhân đồng giới — bằng việc sửa đổi Civil and Commercial Code. Đây không phải chỉ là tin vui pháp lý — đây là cánh cửa thực sự mở ra cho hàng triệu cặp đôi LGBTQ+ tại các nước Châu Á chưa công nhận hôn nhân đồng giới.

Việt Nam, Philippines, Indonesia, Malaysia, Singapore... — đều chưa hợp pháp hóa. Cặp đôi tại các nước này từ trước đến nay phải chấp nhận sống không có giấy tờ hôn nhân, hoặc bay rất xa (Mỹ, EU, Canada) — chi phí cao + thủ tục phức tạp.

Giờ đây, Thái Lan ở ngay cửa nhà: 2-3 giờ bay từ VN, chi phí thấp hơn nhiều, và quan trọng nhất — hôn nhân được luật pháp Thái công nhận đầy đủ với mọi quyền lợi (thừa kế, đại diện y tế, nhận con nuôi...).

Nhưng quy trình KHÔNG đơn giản như nhiều người tưởng

Sau khi tin tức lan rộng, nhiều cặp đôi đã thử tự làm — và gặp 3 vấn đề lớn:

🔴 Giấy tờ Việt Nam cần được chứng thực ĐÚNG CÁCH

Không phải chỉ dịch + công chứng tại VN là xong. Lãnh sự Thái có quy trình xác thực riêng — sai bước nào = giấy không hợp lệ tại Thái, phải về VN làm lại.

🔴 Lựa chọn District Office không hiển nhiên

Bangkok có nhiều District Office (Amphoe). Một số district có cán bộ quen làm hồ sơ quốc tế + nhanh; một số district khác xa lạ với case đồng giới quốc tế + chậm. Chọn sai = mất thời gian + có thể bị từ chối tại chỗ.

🔴 Phối hợp 2 nhân chứng đủ điều kiện

Luật Thái yêu cầu 2 nhân chứng có CCCD/passport hợp lệ và sẵn sàng ký giấy. Cặp đôi đi 1 mình thường gặp vướng mắc tại bước này.

Đây là lý do việc tự làm thường mất 3-4 tuần (thay vì 1-2 ngày như quảng cáo trên mạng) — và đôi khi phải làm lại từ đầu vì sai giấy.

Visa Thái Lan — không chỉ là vào nước, còn là chiến lược

Cặp đôi cần lưu ý: visa vào Thái Lan có nhiều loại, và lựa chọn ĐÚNG quyết định cả trải nghiệm + chi phí + tương lai.

🟢 Visa miễn 30 ngày (cho công dân VN một số quốc tịch khác) — đủ cho chuyến cưới ngắn, nhưng KHÔNG đủ nếu giấy tờ bị delay.

🟡 Tourist visa 60 ngày — an toàn hơn, có buffer thời gian.

🟠 DTV 5 năm — nếu cặp đôi muốn ở Thái dài hạn sau cưới, đây là lựa chọn tối ưu (workation, gap year, retirement).

🔴 Marriage Visa (sau khi cưới) — cho phép cư trú dài hạn nếu một trong hai là công dân/thường trú Thái.

Chọn sai loại visa = phát sinh chi phí + có khi phải bay về làm lại. Đây là phần thuộc tư vấn chiến lược, không phải info có thể chia sẻ general qua bài blog.

Sau khi cưới — đây mới là phần thực sự phức tạp

Có Marriage Certificate Thái rồi — nhưng câu hỏi quan trọng hơn: cặp đôi muốn dùng nó để làm gì?

Trở về VN sống bình thường → Marriage Certificate Thái giúp chứng minh quan hệ trong các tình huống cụ thể (visa thăm thân, mua tài sản chung dạng cá nhân, đại diện y tế nội bộ gia đình...). Tuy nhiên VN chưa công nhận hôn nhân đồng giới về mặt pháp lý.

Định cư nước thứ 3 (Mỹ, UK, Úc, EU, Canada...) → Marriage Certificate Thái có thể được apostille + công nhận tại nước đó. Sau đó cặp đôi có thể apply spouse visa / partner visa để định cư.

Đây là lộ trình nhiều cặp đôi đang theo đuổi — kết hôn tại Thái → định cư tại nước accepting. Nhưng mỗi nước có yêu cầu riêng về spouse visa, và việc chuẩn bị hồ sơ rất khác nhau. Đây là lý do cặp đôi cần một partner xử lý cả 2 phía Thái + nước đến.

A historic milestone for Asia's LGBTQ+ community

On 22 January 2025, Thailand became the FIRST country in Southeast Asia to legalise same-sex marriage — through an amendment to the Civil and Commercial Code. This isn't just legal news — it's a real door opening for millions of LGBTQ+ couples across Asia where marriage equality remains unrecognised.

Vietnam, Philippines, Indonesia, Malaysia, Singapore... none have legalised yet. Couples in these countries have had to accept living without a marriage certificate, or fly across the world (US, EU, Canada) — expensive and complex.

Now Thailand is on the doorstep: 2-3 hours from Vietnam, far lower cost, and most importantly — marriage fully recognised under Thai law with all rights (inheritance, medical decisions, adoption...).

But the process is NOT as simple as many assume

After the news broke, many couples tried to DIY — and ran into 3 major issues:

🔴 Vietnamese documents need correct authentication

Just translating + notarising in Vietnam isn't enough. The Royal Thai Embassy has its own authentication process — miss a step and your documents are invalid in Thailand, forcing a return to Vietnam to redo everything.

🔴 District Office selection isn't obvious

Bangkok has many District Offices (Amphoe). Some officers are experienced with international/LGBTQ+ files and process quickly; others are unfamiliar and slow. Wrong choice = wasted time + possible rejection on the spot.

🔴 Coordinating 2 qualified witnesses

Thai law requires 2 witnesses with valid ID/passport willing to sign. Couples travelling alone often struggle with this step.

This is why DIY typically takes 3-4 weeks (not the 1-2 days advertised online) — and sometimes starting over due to invalid documents.

Thailand visa — not just entry, but strategy

Couples should note: there are multiple visa types for Thailand, and the right choice affects experience, cost, and future plans.

🟢 30-day visa-free (for citizens of certain countries including Vietnam) — enough for short marriage trip, but tight if documents are delayed.

🟡 Tourist visa 60 days — safer buffer.

🟠 DTV 5 years — best option if couple wants long-term Thailand stay after marriage (workation, gap year, retirement).

🔴 Marriage Visa (post-marriage) — allows long-term residence if one partner is Thai citizen or permanent resident.

Wrong visa = extra costs + possibly flying back to redo. This is strategic consultation, not info that can be shared generically in a blog.

After marriage — this is where it gets complex

Holding a Thai Marriage Certificate is one thing — but the more important question is: what do you want to do with it?

Return to Vietnam and live normally → Thai certificate helps prove relationship in specific situations (family visit visas, joint asset purchases as individuals, internal-family medical decisions...). Vietnam doesn't yet legally recognise same-sex marriage.

Migrate to a third country (US, UK, Australia, EU, Canada...) → Thai certificate can be apostilled + recognised locally. Couples can then apply for spouse / partner visa to settle.

This is the path many couples are pursuing — marry in Thailand → migrate to accepting country. But each destination has its own spouse-visa requirements, and the file preparation differs dramatically. This is why couples need a partner who handles both the Thai side AND the destination country.
